Terms of Service

1. Introduction

These Terms of Service ("Terms") constitute a legal agreement between you and TeachTrack ("Company," "we," "us," "our"). These Terms govern your access to and use of TeachTrack, including all content, features, and services offered through our website and mobile application.

2. User Eligibility

To use TeachTrack, you must:

• Be at least 16 years of age (or age of majority in your jurisdiction)
• Be capable of forming a binding legal contract
• Not be restricted from using the service under applicable laws
• Have authority to enter into these Terms on behalf of any organization using the service

If you are under 18, you represent that you have parental or guardian consent to use TeachTrack.

3. Account Registration

When registering for TeachTrack:

• You agree to provide accurate, complete, and current information
• You are responsible for maintaining the confidentiality of your password
• You are fully responsible for all activities that occur under your account
• You agree to notify us immediately of any unauthorized use of your account
• You may not share your account with others or allow others to use your credentials

TeachTrack has the right to disable any account that violates these terms.

4. User Responsibilities

You agree that you will not:

• Use TeachTrack for any illegal, unlawful, or fraudulent purposes
• Violate any applicable laws, regulations, or these Terms
• Infringe on the intellectual property rights of others
• Post or transmit harmful, offensive, or illegal content
• Attempt to gain unauthorized access to TeachTrack's systems
• Upload malware, viruses, or malicious code
• Engage in harassment, bullying, or discrimination
• Share your account credentials with others
• Use TeachTrack for automated scraping or data harvesting
• Reverse engineer, decompile, or disassemble any component of TeachTrack

5. Intellectual Property Rights

TeachTrack and all its content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by TeachTrack, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use TeachTrack for your personal, non-commercial purposes. You may not:

• Reproduce, distribute, or transmit content without permission
• Create derivative works from TeachTrack content
• Use content for commercial purposes
• Remove or alter copyright notices or proprietary markings

6. User Content

By uploading, posting, or submitting content to TeachTrack ("User Content"), you grant TeachTrack a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and distribute your content.

You represent and warrant that:

• You own or have permission to use all User Content
• User Content does not infringe third-party rights
• User Content complies with all applicable laws
• You have obtained necessary rights to share the content

TeachTrack is not responsible for any User Content and may remove or modify content that violates these Terms or applicable laws.

7. Curriculum Content

The curriculum content, lesson plans, and educational materials provided by TeachTrack are derived from the official CBC (Competency Based Curriculum) framework and educational resources. Users may access and use this content for educational purposes only, in accordance with applicable Kenyan and international copyright laws.

8. Payment Terms

If you purchase any paid services through TeachTrack:

• All prices are in the stated currency and subject to change with notice
• You authorize us to charge your payment method for the full amount
• Subscriptions renew automatically unless cancelled before renewal
• Refunds are subject to our refund policy (see Refunds section)
• You are responsible for any currency conversion fees
• All sales are final unless specifically stated otherwise

11. Disclaimer of Warranties

TeachTrack is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, including:

• Accuracy, completeness, or relevance of content
• Merchantability or fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free service
• Security or safety of content transmission

12. Indemnification

You agree to indemnify, defend, and hold harmless TeachTrack and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of TeachTrack, violation of these Terms, or infringement of any third-party rights.

13. Termination

TeachTrack may terminate or suspend your account and access to the service at any time without notice if:

• You violate these Terms
• You engage in illegal activity
• Your payment fails or is fraudulent
• We determine, in our sole discretion, that continued access poses a risk

Upon termination, your right to access TeachTrack ceases immediately.

14. Changes to These Terms

We may modify these Terms at any time. Changes will be effective upon posting to the website. Your continued use of TeachTrack constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of TeachTrack shall be subject to the exclusive jurisdiction of the courts of Kenya.

16. Dispute Resolution

Before initiating any legal proceedings, you agree to attempt to resolve disputes through good faith negotiation. If negotiation fails, disputes shall be resolved through arbitration in Nairobi, Kenya, in accordance with the Arbitration Act of Kenya.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, or if not possible, severed, and the remaining provisions shall continue in full effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TeachTrack regarding your use of TeachTrack and supersede all prior agreements and understandings.
